Muthukumarasamy For Respondent: MS.R.S.INDIRA, GOVT.ADVOCATE (CRL.SIDE) ORDER The petitioners, who apprehend arrest for the alleged offences under Section 296(b), 115(2), 118(1) and 351(3) of the Bharatiya Nyaya Sanhita (BNS), 2023 in Crime No.141 of 2026, on the file of the respondent police seeks anticipatory bail. 2. It is the case of the prosecution that there was a long-standing family land dispute between the petitioners and the defacto complainant; due to previous enmity, the defacto complainant had earlier lodged a complaint against the petitioners. On 21.06.2026, the petitioners allegedly abused the defacto complainant in filthy language, threatened him with dire consequences, and assaulted him, as a result of which he sustained injuries. Hence the case. 3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that they are ready to abide by any stringent condition that may be imposed by this Court and they are ready to co-operate for investigation. https://www.mhc.tn.gov.in/judis CRL OP No. 16793 of 2026 __________ Page3 of 4 Hence, he prays to grant anticipatory bail to the petitioners. 4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that no previous cases have been registered against the petitioner. She further submits that there are totally four accused in this case and that the present petitioners are arrayed as Accused Nos.1 to 3. She further submits that the injured is still undergoing treatment in the hospital. Therefore, she opposes to grant anticipatory bail to the petitioners. 5. This Court has considered the submissions made on either side. 6. From the submissions of the learned Government Advocate, it is seen that the injured is still undergoing treatment in the hospital. In such circumstances, when the investigation is at a crucial stage and the injured has not yet been discharged from the hospital, this Court is of the view that it is premature to consider the prayer for anticipatory bail.
