29.09.2026 Court No.35. D/L.487. Rakib (Rejected) CRM (M) 2274 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar Police Station case no. 2020 of 2025 dated 11.09.2025 under Sections 351(3) of the Bharatiya Nyaya Sanhita, 2023 and 6 of the POCSO Act. And In the matter of : Probhat Mandal ……Petitioner. Mr. Diptonil Dey .....for the Petitioner. Mr. Gouranga Kumar Das, Ld. APP Mr. Narattam Acharyya Mr. Kuntal Roy ……for the State. Learned advocate appearing for the petitioner submits that petitioner is innocent and is in custody for more than a year. The evidence of the victim and the informant is over and the same do not support the prosecution case, as such, petitioner’s further detention is unwarranted. Learned advocate appearing for the State opposes the prayer for bail. I find that the victim is 7 years of age and she has been consistent in her deposition before the Court. Having considered the same, I am of the opinion that the petitioner has failed to make out a case for being released on bail. Accordingly, the prayer for bail of the petitioner in CRM (M) 2274 of 2026 is dismissed. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
