For Petitioner : Mr.R.Dhanasekar For Respondents: Mr.R.Rajasekaran, (for R1) Counsel for Government of Tamil Nadu (Crl.Side) ORDER This Criminal Original Petition has been filed challenging the order dated 04.05.2026 passed in Crl.M.P.No.1049 of 2026 in Crl.M.P.No.1065 of 2025 in C.S.R.No.97 of 2025 by the learned Judicial Magistrate No.I, Tambaram, dismissing the modification petition filed by the petitioner to substitute bank account details for the transfer of the frozen amount. 2. In view of the final order to be passed in this petition at the admission stage itself, notice to the respondents 2 to 4 is dispensed with. 3. The learned counsel for the petitioner submitted that the petitioner is a victim of the cyber fraud. This Court considered the rival submissions made on either side and perused the reasons contained in the impugned order. 6. While no exception can be taken to the findings of the learned Judicial Magistrate as parties are expected to be diligent and provide accurate information before the Trial Court, this Court takes into account the plea that the error was not intended to cause any mischief but was https://www.mhc.tn.gov.in/judis CRL.O.P.No.16590 of 2026 __________ Page4 of 7 merely an innocuous mistake committed by the petitioner. 7. In view of the above, this Court is of the opinion that the requested modification can be permitted.
