The petitioner is apprehending his arrest in connection with Pakur Town PS Case No.299 of 2025, for offence registered under sections 21(a), 22(a) of NDPS Act, pending in court of learned Principal Sessions Judge, Pakur. 3. Learned counsel for petitioner submits that 4.89 grams of brown sugar was recovered from the possession of one Nazim Alam and said Nazim Alam has taken the name of the petitioner. He also submits that even the said quantity is less than the smaller quantity defined under the Act. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.9 of the petition. 4. Learned State counsel opposes prayer and submits that 2026:JHHC:1096 2 name of the petitioner has come on confessional statement of coaccused. 5. Considering that name of the petitioner has come on confessional statement of the coaccused and recovery of said brown sugar is less than the smaller quantity which is recovered from one Nazim Alam, and the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Principal Sessions Judge, Pakur, in connection with Pakur Town PS Case No.299 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
