For the State Affidavit of service filed on behalf of the petitioners is taken on record. The Panchayat is not represented despite service. Learned counsel for the petitioner submits that the petitioners are the recorded owners of the land in question and intend to raise construction therein. Their building plan is yet to be sanctioned by the Panchayat. Representation submitted by the petitioners before the Panchayat on 23rd December, 2025 in this regard is yet to be considered. The petitioners seek consideration of their representation. Upon consideration of the submission made on behalf of the parties, this Court directs the Pradhan, Behariya Gram Panchayat, being the 6th respondent herein, to consider and dispose of the representation submitted by the petitioners dated 23rd December, 2025 within two weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioners in accordance with law. The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is thus disposed of. 2 There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
