For Petitioner(s): Mr.Mohanakrishnan K For Respondent(s): No appearance https://www.mhc.tn.gov.in/judis TR CMP No. 158 of 2026 __________ Page2 of 6 ORDER This Transfer Civil Miscellaneous Petition has been filed to withdraw the case in H.M.O.P.No.985 of 2025 on the file of the Family Court, Coimbatore and transfer the same to the Family Court, Salem. 2.Heard learned counsel for the petitioner and perused the materials available on record. 3.Despite the name of the respondent printed in the cause list, there is no representation. 4.Learned counsel for the petitioner submits that the respondent only with an intention to vandalize and to traumatize the petitioner, has filed this H.M.O.P.No.985 of 2025 before the Family Court, Coimbatore seeking dissolution of marriage. Further, the petitioner is living in Salem, and attending hearings at Coimbatore would involve long hours of travel and additional financial burden, which she is unable to bear in the present circumstances. Being a working woman and a single parent taking care of two minor school going daughters, it is practically impossible for the petitioner to leave the children unattended and travel to Coimbatore for every hearing. He further submits that presently, the petitioner is working as a Teacher in a private school https://www.mhc.tn.gov.in/judis TR CMP No. 158 of 2026 __________ Page3 of 6 at Salem, unable to avail leave frequently from her employment to appear before the Family Court, Coimbatore and repeated absence from work would seriously affect her employment and livelihood. In view of her official responsibilities coupled with her obligation to take care of two minor school going children, it is extremely difficult and arduous for the petitioner to travel to Coimbatore which is about 160 kms. Therefore, he prays to transfer the case to the Family Court, Salem. 5.I have gone through the affidavit filed in support of the transfer petition as well. I find merit in the submissions made by the learned counsel for the petitioner. 6.Considering the facts and circumstances of the case, the submission made by the learned counsel for the petitioner and considering the fact that the petitioner is living in Salem with two school going children, this Court is inclined to transfer the case on the file of the Family Court, Coimbatore to the file of the Family Court, Salem. Accordingly, the case in H.M.O.P.No.985 of 2025 is hereby withdrawn from the file of the Family Court, Coimbatore and transferred to the file of the Family Court, Salem. After receipt of the case papers from the Family Court, Coimbatore, the Family Court, Salem is directed to send a notice to the respondent within four weeks.
