Mr. K.M. Hossain
Ms. Keya Sutradhar
Mr. Kazi Ardan Ali
Mr. Mayukh Saha
…for the petitioner
Mr. Suryaneel Das, Ld. AGP Ms. Suchitra Sinha Chatterjee
…..for the State respondents
Mr. Bhagabat Chowdhury
Ms. Mallika Manna
…for the respondent no. 6
1. Matter is taken up for consideration in presence of learned advocates representing the parties.
2. By presenting this writ petition, prayer is made for directing concerned police authorities to take steps for restoring possession of agricultural land in favour of petitioner which would enable petitioner to cultivate said land in question. Right of petitioner over agricultural land in question is disputed by learned advocate representing respondent no. 6.
3. State respondents are represented by Mr. Das, learned Additional Government Pleader and it is submitted that issue needs to be decided by appropriate
2 forum as to which party is having right to cultivate land in question.
4. Having considered respective submissions made on behalf of parties, it appears that issue centers around right to cultivate agricultural land in question. In one hand, petitioner is claiming right over said land. On the other hand, respondent no. 6 is claiming right as Bargadar of said land.
5. Issue needs to be decided by appropriate forum/authority. Police authority is not the appropriate authority to decide whether petitioner is having right over land in question to cultivate said land or not. If petitioner finds that his right over said land is being denied by respondent no. 6, in that event he needs to approach appropriate forum in pursuit of remedy.
6. However, concerned police authorities are directed to maintain peace and tranquility at the locale and to see that no untoward incident takes place.
7. Writ petition stands disposed of.
8. Parties to act on server copy of this order duly downloaded from the official website of this Court.
