(2) According to petitioner, he was appointed by the erstwhile U.P. Govt. Roadways on 11.1.1971 on the post of Conductor and he retired from the post of Head Clerk from Uttarakhand Transport Corporation on 31.7.2011. According to petitioner, since he was appointed in the pensionable establishment of U.P. Govt. Roadways, therefore, he is entitled for pension. By means of this writ petition, he has sought the following reliefs: “I. Issue a writ, order of direction in the nature of mandamus commanding the respondents to treat the petitioner at par with the government employees and to grant all the benefits admissible to the government employees. II. Issue a writ, order or direction in the nature of mandamus commanding the respondents to pay the pension to the petitioner through treasury like other retired government employees.” (3) Counter affidavit was called vide order dated 24.4.2024 and thereafter more time was given to respondents for filing counter affidavit, but it has not been filed so far. (4) Having regard to the prayer made by the petitioner, this Court thinks that ends of justice would be met if petitioner is permitted to approach the competent authority by making a representation. Writ petition is, 2026:UHC:3401 accordingly, disposed of by permitting the petitioner to make representation to the Managing Director, Uttarakhand Transport Corporation. If he makes representation within two weeks from today, decision thereupon shall be taken, as per law, within three months thereafter.
