With WPA 21988 of 2024 Shrabani Mukhopadhyay & Ors. Vs. The State of West Bengal & Ors. Mr. Ayan Banerjee, Mr. Dhiman Banerjee, …for the Petitioner in WPA 31113 of 2017. Mr. Ekramul Bari, Mr. Syed M. Ali, … for the Petitioners in WPA 21988 of 2024. Ms. Koyeli Bhattacharyya, Mr. Bibek Dutta, … for the WBBSE. Re: CAN 2 of 2024 1. This is an application for addition of party of the five applicants, who are the writ petitioners in WPA 21988 of 2024. 2. Since both the writ petitions have been tagged together considering the fact that common questions of facts and laws are involved in the instant two writ petitions, this Court finds for effective adjudication of both the writ petitions the present five applicants be made party respondent in connection with the WPA 31113 of 2017. 2 3. With the aforementioned observation, CAN 2 of 2024 stands hereby allowed. 4. Let the name of the present applicants be added as party respondent in the Cause Title of WPA 31113 of 2017 by the department forthwith in terms of this order. Re: WPA 31113 of 2017 WPA 21988 of 2024 5. The parties to the instant writ petitions are represented by their respective learned counsel. 6. It is pertinent to mention herein that since identical questions of facts and laws are involved in the instant writ petitions, the instant two writ petitions are tagged together and this Court proposes to pass a common judgment in connection with the instant writ petitions. 7. It is further pertinent to mention herein that since common draft gradation list and common final gradation list as published by the West Bengal Board of Secondary Education (‘Board’ in short) are subject matters as involved in the instant two writ petitions and since the writ petitioner in WPA 31113 of 2017 and the writ petitioners in WPA 21988 of 2024 have taken their contrary stand in respect of the aforementioned two reports, this Court for the convenience while disposing CAN 2 of 2024, which is an application for addition of party in WPA 31113 of 2017, added the respondents in WPA 31113 of 2017 as party 3 respondents and in connection with WPA 31113 of 2017 the writ petition of WPA 21988 of 2024 will be treated as affidavit-in-opposition. 8. This Court has heard Mr. Banerjee, learned advocate appearing on behalf of the petitioner in WPA 31113 of 2017, Mr. Bari, learned advocate appearing on behalf of the petitioners in WPA 21988 of 2024 and Ms. Bhattacharyya, learned advocate appearing on behalf of the respondent- Board in support and against the writ petitions. 9.
