For Petitioner: Mr.C.Prakasam For Respondents: Mr.R.Ganesh Kumar Government Counsel (Crl.Side) [R1 to R5] ORDER This Writ Petition has been filed seeking a direction to the respondents 1 and 3 herein to survey the petitioner's land comprised in Old S.No.65/2, new S.No.65/2C, Avaniperur Keelamugam Village, Edappadi Taluk, Salem District measuring a total extent of 2.75 acres, based on the petitioner's representation dated 10.06.2026. 2. Heard the learned counsel appearing on either side and perused the materials available on record. 3. The petitioner owned a land comprised in Old S.No.65/2, new S.No.65/2C, Avaniperur Keelamugam Village, Edappadi Taluk, Salem District https://www.mhc.tn.gov.in/judis WP Crl. No. 1439 of 2026 ____________ Page No.3 of 6 measuring a total extent of 2.75 acres. In order to survey the said land, the petitioner submitted a representation before the respondents. Subsequently, when the revenue officials attempted to conduct survey on 05.06.2026, the private respondents, namely the respondents 6 to 9, who have no right over the subject property unlawfully interfered with the survey proceedings, threatened the petitioner, revenue officials and prevented the survey proceedings. Therefore, the petitioner has made a representation to the respondents 1 to 3 seeking adequate police protection to the revenue officials to conduct survey and demarcation in the subject property. Since the said representation evoked no response, this writ petition has been filed by the petitioner. 4. In view of the above, the fourth respondent is directed to survey the petitioner's aforesaid land based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner, within a period of six weeks from the date of receipt of copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject property, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police https://www.mhc.tn.gov.in/judis WP Crl.
