This bail application under Section 483 B.N.S.S. has been filed by the petitioner in connection with the FIR No. 17/2026 registered at Police Station Chechat, District Kota Rural wherein he was charged for the offences punishable under Sections 316(3) and 318(4) BNS, 2023. 2. Counsel for the petitioner submits that the petitioner is not named in the aforesaid FIR and the allegations of committing theft of figs are against the co-accused. Counsel further submits that the petitioner has been implicated as an accused as certain boxes of figs have been recovered at his instance. Counsel submits that the alleged offences are triable by the Court of the Magistrate. Counsel further submits that the petitioner is in custody since the date of his arrest. Counsel submits that the trial will take its own time to conclude, therefore indulgence of bail be granted to the petitioner. (2 of 2) [CRLMB-3414/2026]
3. Per contra, learned Public Prosecutor opposed the bail application. 4 Heard and considered the submissions made at Bar and perused the material available on record. 5. Considering the arguments put forward by learned counsel for the petitioner and looking to the fact that the alleged offences are triable by the Magistrate and also looking to the fact that the petitioner has been in custody since the date of his arrest and the trial will take its own time to conclude, hence, without expressing any opinion on merits and demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioner under Section 483 BNSS. 6.

Accordingly, this bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner-Yasar S/o Saleem Shah arrested in connection with the aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
