I have heard the learned Counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondent. 3. Upon perusing the Final Report filed, it can be seen that the petitioner was travelling from Mysore to Coimbatore. On the way, when he was intercepted, he was in possession of one bottle of liquor of 700 ml, which he purchased from Karnataka. 4. The learned Counsel for the petitioner would submit that when the same was taken by the petitioner for personal consumption, the F.I.R was registered. 5. Considering the fact that there is not even any material that is collected and filed along with the Final Report to point out that the same was brought in for sale and that the bottle originated from Karnataka and 2/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.17079 of 2026 considering the fact that the petitioner has no other antecedent, I am of the view that this is a fit case for exercise of jurisdiction under Section 528 of B.N.S.S. 6. In view thereof, this Criminal Original Petition is disposed of. The Final Report and all the further proceedings in C.C.No.212 of 2025 on the file of the learned Judicial Magistrate, Sathyamangalam, shall stand quashed.
