For Petitioner(s): Mr.M.Shankar For Respondent(s): Mr.S.Sairaman https://www.mhc.tn.gov.in/judis TR CMP No. 163 of 2026 __________ Page2 of 6 ORDER This Transfer Civil Miscellaneous Petition has been filed to withdraw the case in H.M.O.P.No.1053 of 2025 on the file of the Subordinate Judge, Alandur and transfer the same to the Family Court, Chennai. 2.Heard both sides and perused the materials available on record. 3.Learned counsel for the petitioner submits that the respondent filed a petition in H.M.O.P.No.1053 of 2025 before the Subordinate Judge, Alandur, seeking divorce. He submits that the petitioner is an adult orphan and unemployed single woman. Further, there is no one for the petitioner to take care of her and support her. He further submits that the petitioner is struggling to take care of her day-to-day expenses making travel burdensome and unsafe due to the conduct of the respondent. He further submits that if the above H.M.O.P is not transferred, the petitioner will be put to serious hardship and prejudice. Therefore, he prays to transfer the case to the Family Court, Chennai. https://www.mhc.tn.gov.in/judis TR CMP No. 163 of 2026 __________ Page3 of 6 4.Learned counsel for the respondent has not raised any serious objection in transferring the case from the Subordinate Judge, Alandur to the Family Court, Chennai. 5.I have gone through the affidavit filed in support of the transfer petition as well. I find merit in the submissions made by the learned counsel on either side. 6.Considering the facts and circumstances of the case, the submission made by the learned counsel on either side and considering the fact that both the parties are residing in Chennai, this Court is inclined to transfer the case on the file of the Subordinate Judge, Alandur to the file of the IV Additional Family Court, Chennai. Accordingly, the case in H.M.O.P.No.1053 of 2025 is hereby withdrawn from the file of the Subordinate Judge, Alandur and transferred to the file of the IV Additional Family Court, Chennai. After receipt of the case papers from the Subordinate Judge, Alandur, the IV Additional Family Court, Chennai is directed to send a notice to both the parties within four weeks.
