1. This bail application has been filed by the accused petitioner u/S 483 BNSS in connection with FIR No. 36/2026 registered at Police Station Anta, District Baran for offence u/S 8/21, 8/30 of the NDPS Act and Section 27 of the Drugs and Cosmetics Act
1940.
2. Heard learned counsel for the petitioner as well as the Public Prosecutor.

Learned counsel for the accused petitioner submits that the accused petitioner has been implicated as an accused only because the co-accused Surendra used the vehicle-motorcycle registered in the name of the accused petitioner while he was found in the possession of the alleged contraband. He further submits that no contraband has been recovered from the possession of the accused petitioner and he is in custody since 21.02.2026 and after conclusion of investigation, the police has submitted charge-sheet in the matter and the allegation against
[2026:RJ-JP:15653] (2 of 2) [CRLMB-3844/2026] the accused petitioner for the offence punishable under Section 8/25 of the NDPS Act.
4. Learned Public Prosecutor vehemently opposed the bail application and submits that two other criminal cases are pending against the accused petitioner.

Taking into consideration the submissions made by learned counsel for the accused petitioner so also the allegations against him and the fact that the co-accused Surendra, form whose possession the alleged contraband was recovered, has been enlarged on bail vide separate order, this Court, without expressing any opinion on the merits/demerits of the case, deems just and proper to enlarge the accused-petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
7. In case the accused-petitioner is found to be involved in any other criminal case of similar nature in future, the prosecution may move application for cancellation of his bail.
