Sl. No. - 13 Court No.35 Rohan (Rejected) IN THE HIGH COURT AT CALCUTTA CRIMINAL MISCELLANEOUS JURISDICTION APPELLATE SIDE
C.R.M.(A) 2999 of 2026
In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Basirhat Police Station Case No. 556 of 2026 dated 03.07.2026 for the offences punishable under Sections 308(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 8/12/17/18 of the POCSO Act.
-And-
In the matter of: Akram Hossain Gazi …Petitioner
Mr. Kallol Kumar Basu Mr. Md. Jannat ul Firdous Mr. Rajsekhar Hota
…for the Petitioner
Mr. L. Vishal Kumar Mr. Sanjib Das …for the State
Mr. Tanweer Jamil Mandal Mr. Debopriyo Karan … for the De facto Complainant
1. Learned advocate appearing for the petitioner prays for anticipatory bail of the petitioner. He claims that the petitioner is innocent and the present case is a counter-blast.
2. Learned advocates for the State and the de facto complainant oppose the prayer for bail.
3. Case diary has been produced.
4. I have taken into account the statement of the victim under Section 183 of the BNSS and I find that there are accusations against the present petitioner apart from others that he was
2 dragging the victim which resulted in injuries. The spirit of the statement under Section 183 of the BNSS prima facie reflects that an offence has been made out.
5. Having considered the nature of the offence, I am of the opinion that this is not a fit case for granting anticipatory bail to the petitioner.
6. Accordingly, the prayer for anticipatory bail of the petitioner, namely, Akram Hossain Gazi is rejected.
7. With the aforesaid observation, C.R.M. (A) 2999 of 2026 is dismissed.
8. Memo of evidence and the report submitted be kept with the record.
9. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.
10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
