ORAL ORDER (PER: HON'BLE MR. JUSTICE JAYANT BANERJI)
This petition is filed alleging wilful disobedience of the
order dated 03.09.2025 passed in Writ Petition No.25352/2025. By the order of the writ Court, the petition was disposed of, the operative part of which, reads as follows:
"3. Accordingly, the writ petition stands
disposed of with a direction to respondent No.3 - Tahasildar, Magadi Taluk to consider the representation given by the petitioner No.2 at Annexure - G dated 10.01.2024, verify from the records and find out whether late Sri.Chikkanna @ Chikkaiah was indeed granted the land. If it is found that the Committee had in fact regularised the land in favour of Sri.Chikkanna, the Tahasildar shall proceed to pass necessary orders issuing Saguvali chit and enter name in the land records pursuant to the issuance of the Saguvali chit. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of this order."
2. A compliance affidavit was filed by the learned AGA on 27.04.2026 enclosing therewith, the proceedings of the land grant committee, the relevant records available in the concerned file, final information letter / Challan record, copy of the RTC and FID records standing in the name of the family of the complainants. Form No.50, the relevant application is found in the office file. However, it was found that no entry evidencing submission of application in Form No.50 is available in the Application Received Register. There are material discrepancies in the name of the alleged grantee, namely Chikkanna S/o. Kalakataiah, Chikkanna S/o. Kataiah and Chikkanna S/o. Elekataiah. In the Form 50 application, the name of Chikkanna S/o. Elekataiah appears. Paragraph Nos.9 to 11 of the compliance affidavit read as follows:
"9. I further state that a final intimation letter was issued during the year 1996-97 directing payment of required land value, the records disclose that the said amount was not paid, and hence the grant proceedings did not attain finality. 10. I state that as per verification of FID and RTC records, the family of the petitioners is in possession of land measuring 6 acres 22 guntas, and therefore they are not eligible for grant of Government land under Rule 4(1) of the Karnataka Land Grant Rule, 1969. 11. I state that in view of the above findings, and after thorough consideration of all available records, a speaking endorsement bearing No.TAHMGD-LND02/9/2026 dated 09.04.2026 was issued to the Petitioners, rejecting their request for issuance of Saguvali Chit and mutation.
Copy of the said endorsement dated 09.04.2026 along with postal acknowledgment is herewith produced as ANNEXURE- R4 for kind perusal of this Hon'ble Court."

3. An unconditional apology has also been tendered. We have perused the proceedings of the Land Grant Committee that is Annexure R1 and the endorsement issued that is Annexure R4. In view of the facts and circumstances revealed in the endorsement and in the affidavit, we do not find that a case of contempt is made out. As a matter of fact, the resolution of the committee reflects the name of Chikkanna S/o Kalakattaiah whereas, as per the affidavit, the Form 50 application is in the name of Chikkanna S/o Elekataiah. 4. As a matter of fact, in the final intimation letter Annexure R2, the name of Chikkanna S/o Kattayya appears and in the RTC at page 20 of the compliance affidavit shows the name of Elekataiah S/o Siddappa. 5. It is pertinent to mention here that on the last date of listing that is on 18.09.2026, the following order was passed:
"A compliance affidavit filed on 27.04.2026 is on record, which encloses an endorsement dated 09.04.2026, declining the request of the complainant for issuance of Saguvali Chit and rejecting his application. The said endorsement is stated to have been communicated to the complainant by speed post, which was dispatched on 25.04.2026. - 6 -
