CRM-M-23015 seeks anticipatory bail in case Sections 109(1), 115, 126, 190, 191(3), 61(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023, at Police Station Murthal, District Sonepat 2. On the BNSS, 2023 is for grant of anticipatory bail to the petitioner in case FIR No.398 dated 14.12.2025 registered under Sections 109(1), 115, 126, 190, 191(3), 61(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023, at Police Station Murthal, District Sonepat. petit further submitted that the petitioner was neither named in the FIR, nor has any concern with the said offence. It has also been contended that the petitioner has been nominated as an accused only on Kartik. Apart from the disclosure statement, there is no other evidence to connect the petitioner with the offence in question and it is a trite law that disclosure statement of the co durin argued that if the contents of the FIR are taken to be true, even then no specific injury has been attributed to the present petitioner and it is the co to t accused has already been granted the concession of bail by the learned trial Court. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. He further submitted that the petitioner was neither named in the FIR, nor has any concern with the said offence. It has also been contended that the petitioner has been nominated as an accused only on the basis of the disclosure statement made by co Kartik. Apart from the disclosure statement, there is no other evidence to connect the petitioner with the offence in question and it is a trite law that disclosure statement of the co during his custodial interrogation is not admissible. He further argued that if the contents of the FIR are taken to be true, even then no specific injury has been attributed to the present petitioner and it is the co-accused Kartik, who inflicted injuries to the complainant. He further submitted that the said co accused has already been granted the concession of bail by the learned trial Court. Learned counsel has further submitted that the petitioner is ready and willing to join the investigation as and when called upon to do so by the investigating agency.
