For Petitioner(s): MR.V.S.Senthilkumar For Respondent(s): ORDER The Revision Petitioner has filed this Civil Revision Petition challenging the fair and decretal order dated 07.04.2026 passed in E.P. No.33 of 2025 on the file of the II Additional Subordinate Court, Coimbatore. CRP No. 3536 of 2026 2. The learned counsel for the petitioner submitted that the respondent/Decree Holder initiated execution proceedings on the strength of an ex parte decree. He further submitted that the petitioner has already filed I.A.No.73 of 2017 to set aside the ex parte decree and the said application is still pending. Pending disposal of the said application, the Decree Holder has proceeded with the execution proceedings and the Executing Court has also ordered attachment. Therefore, the petitioner seeks stay of all further proceedings in E.P. No.33 of 2025 till the disposal of I.A. No.73 of 2017. 3. Considering the submissions made by the learned counsel for the petitioner and having regard to the facts and circumstances of the case, this Court is inclined to grant stay, subject to the condition that the petitioner shall deposit a sum of Rs.20,000/- before the Executing Court within a period of four weeks from the date of receipt of a copy of this order. On such deposit being made, all further proceedings in E.P. No.33 of 2025 on the file of the II Additional Subordinate Court, Coimbatore, shall remain stayed till the disposal of I.A. No.73 of 2017. CRP No. 3536 of 2026 4. The learned II Additional Subordinate Judge, Coimbatore, is directed to dispose of I.A. No.73 of 2017, on its own merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 5. With the above directions, this Civil Revision Petition stands disposed of. Consequently, the connected miscellaneous petition is closed.
