Choudhury, learned counsel for the petitioners and Ms. P. Mazumder, learned counsel appearing for the CBI. This is an application under Section 528 BNSS praying for quashing the orders dated 02.03.2026 and 02.04.2026 passed by the learned CJM, Kamrup(M), Guwahati in CR Case No. 716/2022. The petitioners are residents of the State of Manipur and because of the ethnic violence going in the State they could not come and appear before the court below in spite of Non Bailable Warrant of Arrest issued against them by the trial court. The petitioners have submitted that they now want to appear before the trial court and they should be given some opportunity to that effect. I have considered the submission made by the learned counsel for Page No.# 3/3 the petitioners. The ground of non appearance is satisfactory, therefore, the prayer of the petitioner is allowed. Accordingly, the orders directing issuance of non bailable warrant of arrest against the petitioners, namely (1) Ms. Yumnam Sundari Devi (2) Ms. Yumnam Romi Devi (3) Ms. Khuraijam Ibempishak Devi (4) Ms. Wahengbam Sorodhoni Devi (5) Ms. Sapam Chaoba Devi are hereby set aside. The petitioners are directed to appear before the trial court within 30 days and on their appearance they shall be allowed to go on fresh bail bond of Rs.20,000/- with suitable surety of like amount to the satisfaction of the learned CJM, Kamrup(M), Guwahati.
