Gurung, Adv JUDGMENT: (per the Hon’ble, the Chief Justice): (Oral) In the petition, the petitioner has sought quashing and setting aside of the transfer order issued by the respondent No.3- HQ, IGAR (S/E/Headquarter/10/21/27 Set AR, vide order dated 24th October, 2025, in respect of the petitioner. Serial No.01 Daily List 2026:MLHC:694-DB 2. Several orders came to be passed in the aforesaid appeal from time to time, as it was the appellant’s contention that the appellant was suffering from 60% disability and that he could not be able to manage his day-to-day activities without the support of his family, the place of transfer being a non-family station. 3. On 29th June, 2026, we had passed the following order: “Pursuant to the order dated 21st May, 2026 passed by this Court, Dr. Mozika, learned DSGI has tendered the report of the Medical Board. The said report of the Medical Board is taken on record. 2. From the said Medical Board’s report, it appears that the Board has verified the disability of the appellant and has found him to be suffering from i.e., (i) CVA with Hemiparesis (LT) and (ii) DM Type-2. The composite disability in (i) is stated to be 60% and (ii) 5%. The total composite disability is stated to be 62%. 3. We are also informed by the learned counsel for the appellant that pursuant to the order dated 21st May, 2026 passed by this Court, the appellant has joined the non- family station assigned to him, however, is presently on leave i.e., leave sanctioned by the authority. 4. Considering the nature of the disability mentioned in the report given by the Medical Board, Dr. Mozika, seeks time to take instructions whether the appellant can be transferred to a family station, anywhere as the authority may deem fit and proper. Time granted. 5. On his request, stand over to 10th July, 2026.” 2026:MLHC:694-DB 4. Today, Dr. Mozika, learned DSGI has tendered a letter dated 8th July, 2027 issued by the concerned authorities. The said letter is taken on record. From the said letter, it appears that the appellant’s case has been reconsidered and that he has now been posted to 34 Assam Rifles (Aizawl/Good), which is a family station vide order dated 7th July, 2026 (medical posting). Since the appellant has been transferred to a family station as sought by him, in view of his physical disability, nothing survives for further consideration in the appeal. 5. The appeal stands disposed of accordingly. (W.
