For Petitioner(s): Mr.K.A.Vimalkumar For Respondent(s): No appearance https://www.mhc.tn.gov.in/judis TR CMP No. 342 of 2026 __________ Page2 of 6 ORDER This Transfer Civil Miscellaneous Petition has been filed to withdraw the case in H.M.O.P.No.37 of 2026 on the file of the Subordinate Court, Dharapuram and transfer the same to the Family Court, Karur. 2.Heard learned counsel for the petitioner and perused the materials available on record. 3.Despite the name of the respondent printed in the cause list, there is no representation. 4.Learned counsel for the petitioner submits that the respondent only with an intention to vandalize and to traumatize the petitioner, has filed this H.M.O.P.No.37 of 2026 before the Subordinate Court, Dharapuram seeking dissolution of marriage. He submits that the petitioner is living in Karur and working as a Teacher and she has 3 years old female child and taking care of all her basic needs only with the help of her aged parents and her father is facing severe financial crisis to maintain the increasing expenses of the petitioner and her daughter from his limited savings amount. Further, the distance between the petitioner’s residence and the Court is about 121 kms. and it is very difficult for her to attend each and every hearing before the Subordinate Court, https://www.mhc.tn.gov.in/judis TR CMP No. 342 of 2026 __________ Page3 of 6 Dharapuram. He further submits that the petitioner does not have any one to accompany with her during the dates of hearing from Karur to Dharapuram. Therefore, he prays to transfer the case to the Family Court, Karur. 5.I have gone through the affidavit filed in support of the transfer petition as well. I find merit in the submissions made by the learned counsel for the petitioner. 6.Considering the facts and circumstances of the case, the submission made by the learned counsel for the petitioner and considering the fact that the petitioner has 3 years old female child and living in Karur, this Court is inclined to transfer the case on the file of the Subordinate Court, Dharapuram to the file of the Family Court, Karur. Accordingly, the case in H.M.O.P.No.37 of 2026 is hereby withdrawn from the file of the Subordinate Court, Dharapuram and transferred to the file of the Family Court, Karur. After receipt of the case papers from the Subordinate Court, Dharapuram, the Family Court, Karur is directed to send a notice to the respondent within four weeks.
