Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioners seeking following reliefs :- 2 a) Issue an appropriate writ, order or direction direction respondent No. 3- Collector, Surguja, to decide the petitioner’s application for grant of permission to sell rehabilitation land under Section 167 (7-B) of the Chhattisgarh Land Revenue Code, bearing Revenue proceeding No. 202308020700011, year 2022-2023, Class B-121, within a stipulated time frame, preferably within an outer limit of 15 days; b) Pass any other order or direction which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice. 2. Learned counsel appearing for the petitioners would submit that the petitioners are recorded owner of the land bearing Khasra No. 24/1, area 2.400 hectare situated at village Subhash Nagar, Patwari Halka No. 17, R.N.M. Ambikapur-4, Tehsil Ambikapur, District Surguja (C.G), which was allotted to husband of petitioner No. 1, namely, Late Bhuvan Sheel as rehabilitation land. After death of late Bhuvan Sheel, aforesaid land is recorded in the name of petitioners in the revenue records. On account of financial need, the petitioners filed an application under Section 165 (7-B) of the Chhattisgarh Land Revenue Code, 1959 (for short, “the Code, 1959”) for grant of permission to sell 1.00 acres of aforesaid land on 24.07.2023 (Annexure P-2). It is next contended that report has been sought for by the Collector from concerned Sub Divisional Officer (Revenue) and other revenue officers, despite that application (Annexure P-2) has not been decided yet, hence, he prays that respondent No. 3/ Collector, Ambikapur, Distt. Surguja (C.G.) be directed to take a final decision on application (Annexure P-2) filed by the petitioners. 3 3. Learned counsel for the State submits that the application filed by the petitioner is under consideration, necessary report has been sought for, as such, application shall be decided in accordance with law in near future. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Having considered the limited prayer made by counsel for the petitioners, without entering into the merits of the case, this petition is disposed of directing respondent No. 3 / Collector, Ambikapur, District Surguja (C.G.) to take final decision on the application (Annexure P-2) dated 24.07.2023 filed by the petitioners in accordance with law expeditiously preferably within a period of 45 days from the date of receipt / submission of copy of this order. 6. With the aforesaid observations & directions, this petition is disposed of. 7. Pending interlocutory application (s), if any, stands dispose of.
