Advocate (Criminal Side) https://www.mhc.tn.gov.in/judis CRL MP No. 8661 of 2026 __________ Page2 of 5 ORDER This application has been filed for the suspension of sentence under Section 389(1) of Cr.P.C / 430(1) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, pursuant to the judgment of the learned Additional District Judge / Special Court under EC Act & NDPS Act Cases, dated 18.12.2025 in C.C.No.145 of 2017. 2.The Petitioner is the accused in the aforementioned case. She has been convicted by the Trial Court for offences under Sections 8(c) r/w 20(b)(ii) (C), 25 and 29(1) of the NDPS Act. 3.The punishments imposed on the Petitioner/Appellant by the Trial Court vide its conviction dated 18.12.2025 are as follows: Sections under which the Petitioner/Appellant-Accused is convicted Punishment Section 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985. Rigorous Imprisonment for a period of 20 years and fine of Rs.1,50,000/- in default, to undergo Rigorous Imprisonment for a period of one year each for the each of the offence u/s 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985. https://www.mhc.tn.gov.in/judis CRL MP No. 8661 of 2026 __________ Page3 of 5 4.It is noticed that there were three other accused and that during the pendency of the trial A2 died and therefore, the case against A2 stood abated. As far as A3 & A4 are concerned, they have also been convicted under Section 8(c) r/w 20(b)(ii)(C) and 29(1) of the NDPS Act, 1985 and sentenced to undergo Rigorous Imprisonment for a period of twenty years each and to pay a fine of Rs.1,50,000/- each in default, to undergo Rigorous Imprisonment for a period of one year each for each of the offence u/s. 8(c) r/w 20(b)(ii)(C) and 29(1) of the NDPS Act, 1985. 5.It is informed that their appeal is also pending before this Court in Crl.A.No.54 of 2026. The Petitioner appears to be involved in several other case and the quantity of Ganja carried by the Petitioner as found by the Trial Court appears to be a commercial quantity and has been treated as an offence against the society. 6.Considering the same, I am not inclined to grant any relief to the Petitioner at this stage and therefore, this Criminal Miscellaneous Petition is dismissed. 7.Registry is directed to call for the records and list the main case for final hearing along with Crl.A.No.54 of 2026 on 27.07.2026. https://www.mhc.tn.gov.in/judis CRL MP No. 8661 of 2026 __________ Page4 of 5 8.The learned Government Advocate (Crl.Side) for the Respondent is directed to be ready on the next date of hearing for final disposal of this case. 24-06-2026 GBI To 1.The State Rep.by, The Inspector of Police, NIB CID, Coimbatore District.
