28 2299..0099..22002266 Ct. No. 05 adeb WPA 25114 of 2026 Chiranjit Murmu Vs. The State of West Bengal & Ors. Mr. Ranajoy Chatterjee Mr. Swarnajit Das Mr. Soumik Maity …for the petitioner Mr. Tapas Kumar Chatterjee Mr. Sourya Mukherjee …for the State 1. By presenting this writ petition petitioner prays for direction upon the concerned police authorities to register FIR based on complaint lodged. Petitioner is father of victim girl. It is submitted that in spite of lodging complaint steps have not been taken by the police authorities. 2. Learned advocate representing State respondents submits that taking note of complaint of mother of victim girl case was registered and in connection therewith arrests were made. 3. There is an alternative remedy available to petitioner under Section 175(3) BNSS 2023 in the event based on complaint lodged by petitioner FIR is not registered. In this regard reliance is placed on the judgment of Hon’ble Supreme Court reported in (2007) 6 SCC 171 2 (Aleque Padamsee and Others vs. Union of India & Others). 4. In view of availability of alternative remedy present writ petition is not entertained and same stands dismissed. 5. However, this order shall not preclude the petitioner to approach jurisdictional Magistrate in pursuit of remedy. 6. Parties to act on server copy of this order duly downloaded from the official website of this Court. (Saugata Bhattacharyya, J.)
