JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The present writ petition is filed calling in question the endorsement dated 06.04.2023 bearing No.UNOKA/Bum/06/2023-24 issued by respondent No.2, produced at Annexure-A, whereby the jurisdictional Sub- Registrar has declined to register the sale deed on the ground that the document is not accompanied by a 11E sketch. - 3 - HC-KAR NC: 2026:KHC:18194 WP No. 22327 of 2024 2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Advocate appearing for the respondents. Perused the material on record. 3. This Court has also taken note of the Record of Rights, produced along with the memo dated 02.04.2026. It is not in dispute that the petitioner has purchased an undivided half share in land bearing Sy.No.60/P34, measuring 1 acre 20 guntas, from one Sri Rajagopalaiah. A perusal of the RTC pertaining to the said survey number reveals that the vendor, namely Sri Rajagopalaiah, is recorded as holding an extent of 1 acre 20 guntas out of the total extent of 3 acres comprised in the said survey number. Thus, the transaction in question relates to conveyance of an undivided share in a larger extent of land. 4. In that view of the matter, the contention urged by the learned Additional Government Advocate merits acceptance. When the transaction pertains to transfer of an undivided share in an agricultural land forming part of a larger survey number, the same necessarily requires prior identification and demarcation through a phodi/sub-division - 4 - HC-KAR NC: 2026:KHC:18194 WP No. 22327 of 2024 process, culminating in issuance of a sketch under Section 11E of the Karnataka Land Revenue Act. In the absence of such a 11E sketch, the property sought to be conveyed remains unidentifiable with precision and, therefore, the jurisdictional Sub-Registrar would be justified in declining registration of the document. Consequently, the endorsement issued by respondent No.2 cannot be found fault with. 5. However, having regard to the fact that the petitioner has already acquired rights under the sale transaction, this Court deems it appropriate to reserve liberty to the petitioner to submit an online application seeking issuance of a 11E sketch. If such an application is submitted, the competent revenue authorities, namely respondent Nos.3 to 5, shall consider the same in accordance with law and take necessary steps to measure the land in Sy.No.60/P34, undertake sub-division, and thereafter issue the requisite 11E sketch. 6. For the foregoing reasons, this Court proceeds to pass the following: - 5 - HC-KAR NC: 2026:KHC:18194 WP No. 22327 of 2024 ORDER i. The writ petition stands disposed of reserving liberty to the petitioner to submit an online application seeking issuance of a 11E sketch in respect of land bearing Sy.No.60/P34. ii. Upon receipt of such application, respondent Nos.3 to 5 shall take cognizance of the same and undertake a fresh survey and measurement of the subject land, after securing all relevant revenue records pertaining to the said survey number, and thereafter carry out sub-division (phodi) in accordance with law and issue the 11E sketch. iii.
