This petition has been filed by the petitioners with the prayer to direct the Assistant Collector (First Class) to forthwith conduct demarcation of petitioners’ land comprised in Khata No.52 Kha, Khasra No.122 ad measuring 0.0762 hectares situated in Village Dobra, Tehsil Rishikesh, District Dehradun. 4. It is the case of petitioners that they purchased the aforesaid land from one Smt. Bindra Devi on 24.02.2005, and possession thereon was handed over to the petitioners after sale. In between, one house, which was standing over the said land, was taken in possession by Gram Panchayat Asaina, Block Doiwala, District Dehradun. 5. Since the house standing on the land in question has been encroached upon by Gram Panchayat, therefore, the prayer for demarcation will not help the petitioners in any manner. The petitioners are free to file a civil suit in the competent court of jurisdiction for removal of encroachment, if any, made by Gram Panchayat Asaina, Block Doiwala, District Dehradun or restoration of possession of the house. 6. In such view of the matter, no interference is called for. The writ petition is, accordingly, dismissed. (Hon'ble Pankaj Purohit, J.) 22.04.2026 R.Dang
