When the matter came up for hearing, the learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the second respondent/Bank had filed a criminal complaint before the learned Judicial Magistrate No.III, Kolkata, and that a non-bailable warrant has already been issued and transmitted to the respondent police for execution. It was further submitted that the respondent police is only taking steps to execute the said warrant. 3. In view of the same, it is open to the respondent police to execute the warrant. It is also open to the petitioner to approach the appropriate Court seeking recall of the warrant, in the manner known to law. 4.
