The Writ of Mandamus has been instituted to direct the 2nd Respondent to consider the petitioner’s representations dated 11.09.2023 and 07.02.2025, to refix the petitioner’s seniority for the post of assistant from the year 2022 instead of the year 2023 and place him in the appropriate seniority before his Juniors and provide notional promotion and grant him the pay, service, monetary and all other benefits on par with his juniors. 2.The petitioner was appointed as Junior Assistant in the Tamil Nadu Judicial Ministerial service on 25.06.2019. The petitioner underwent Bhavani Sagar Training belatedly at the instance of the administration. Since there was a delay in sponsoring his name for completion of the Bhavani Sagar https://www.mhc.tn.gov.in/judis 2026:MHC:2504 WP No. 14937 of 2025 __________ Page3 of 4 Training, the said delay in completing the Bhavani Sagar training cannot be attributed against the writ petitioner. The Registrar (District Judiciary) addressed a letter to the Additional Chief secretary to the Government dated 22.06.2026 to declare the probation of the petitioner along with other Junior Assistants who all are similarly placed with retrospective effect as on the actual date of completion of two years. In other words, a proposal has already been submitted to the Government for grant of relaxation of relevant rules and to declare the probation with retrospective effect from the date on which the employee completed two years of service. 3.In view of the above facts, the 4th respondent is directed to consider the proposal submitted by the High Court in R.O.C.No.49487/2023/C3 dated 22.06.2026 and pass appropriate final orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. 4.With these directions, the Writ Petition stands disposed of.
