Mr. Avik Sengupta Mr. Amar Krishna Saha Mr. Satyajit Senapati ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), Bidhannagar, 24 Parganas (North) to dispose of Title Suit No. 185 of 2002 expeditiously. The learned advocate appearing for the petitioner submits that the suit was fixed for argument and thereafter an application was filed by the opposite parties praying for adducing evidence and an application was accordingly filed. He submits that 8th October, 2026 is fixed for hearing of such application. He submits that in spite of a direction passed by the Co-ordinate Bench to dispose of the suit expeditiously, the suit is yet to be disposed of. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties 2 or upon the learned advocates representing them before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, C.O. 3292 of 2026 stands disposed of by requesting the learned Civil Judge (Junior Division), Bidhannagar, 24 Parganas (North) to take up the hearing of the recall petition on 8th October, 2026 and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the said application the learned trial judge shall make an endeavour to dispose of Title Suit No. 185 of 2002 keeping in mind that the suit is pending from the year 2002. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
