1. Heard Mr. T. J. Mahanta, learned counsel for the petitioners. Also heard Mr. M. Ali, learned counsel for the informant and Mr. B. Sarma, learned Additional Public Prosecutor, for the State respondent. 2. This is an application under Section 482 BNSS, 2023 praying for granting transit anticipatory bail to the accused/petitioners, (1) Tafazzal Haque (2) Musharraf Hossain (3) Amej Ali (4) Jakir Hussain (5) Ahidur Rahman, who are apprehending arrest in connection with Dalgaon Case No. 41/2026 under Section 103(1) /118(2) /190 /191(2)/324(4)/329(3) BNS. 3. It is submitted by the learned counsel for the petitioners that the petitioners denied their involvement in the incident. It is submitted by the learned Senior counsel that there is also a cross FIR. 4. On the other hand, the learned Additional Public Prosecutor supporting the bail objection filed by the IO submits that as many as 11
Page No.# 3/3 injuries have been found on the dead body of the deceased. It is submitted that other petitioner is also implicated by the testimony of eyewitnesses. 5. The learned counsel appearing for the informant and also objecting to the bail, submits that the petitioners are involved in the alleged offences. He submits that he has serious objection to grant a bail to the accused petitioners, including the said Gaon Burah. 6. I have perused the relevant portions of the case diary. The PM report reveals as many as 11 injuries including lacerations, fracture, etc. The investigation has found basis in the allegations regarding assault.
Perused the statements of several witnesses which lend support to such allegations. There are implications against the petitioner in the materials revealed by the investigation. 7. Considering the nature of the alleged offences and the materials revealed by the investigation including the medical/ forensic findings and as the investigation is still in progress, I do not find sufficient merit in this petition for pre-arrest bail, at least at this stage. 8. In such view of the matter, instant petition for pre-arrest bail stands rejected at this stage. 9. Accordingly, the bail application stands disposed of. 10. Return back the cases diary.
