1. Mr. Susheel Kumar, learned holding brief of Mr. Gaurav Singh, learned counsel for the petitioner.
2. Ms. Rangoli Purohit, learned Brief Holder for the State.
3. By the instant writ petition, petitioner is praying for the following relief:
“i. Issue a writ, order or direction in the nature of certiorari quashing the impugned FIR lodged by respondent no. 3 on 31.01.2026 registered as case crime no. 35 of 2026 under Section 3, 5, 11 of the Uttarakhand Protection of Cow Progeny Act, 2007, Police Station – Pathari, District – Haridwar. ii. Issue a writ, order or direction in the nature of mandamus commanding the respondents no. 1 and 2 not to arrest the petitioner and not take any coercive measure against the petitioner in pursuance to the impugned FIR dated 31.01.2026 registered as FIR No. 35 of 2026 under Section 3, 5, 11 of the Uttarakhand Protection of Cow Progeny Act, 2007, Police Station – Pathari, District – Haridwar against the petitioner (contained as Annexure No. 1 from 12 to 18 to the writ petition) qua the present petitioner.”
4. After arguing at length, learned counsel for the petitioner submits that petitioner is ready to surrender before the court concerned on or before 28.05.2026, however, he may be given some protection till such time.
5. State Counsel has no objection to it.
6. In such view of the matter, the instant petition is dismissed with liberty to the petitioner to surrender before the court concerned on or before 28.05.2026 till then no coercive action shall be taken against the petitioner.
