1. The petitioner has challenged the order dated 2.12.2024 whereby the seized vehicle Car bearing registration No.C.G.10 EG 9500 was
directed to remain in possession of the police.

Learned counsel for the petitioner would submit that without any authority of law the vehicle is in possession of the police.
3. On the other hand, learned counsel for the State would submit that the vehicle bearing registration No.C.G.10 EG 9500 was involved in the accident. He would contend that Claim Case No.33 of 2024 was filed by respondents No.1 to 3 on account of injuries sustained by them for grant of compensation and the learned Tribunal passed an award to the tune of Rs.7,05,000/- and fastened liability with the owner of the vehicle. He would submit that as the owner of the vehicle failed to make payment of compensation, therefore, the vehicle has not been released.

Taking into consideration the fact that the Car bearing registration No.C.G.10EG 9500 was involved in the accident and at that time, it was not insured, therefore, the learned Claims Tribunal fastened the liability with the owner of the vehicle and passed an award to the tune of Rs.7,05,000/- and therefore, the vehicle of the petitioner has not been released yet.
6. Taking into consideration the above-discussed facts, the impugned
order was passed on 2.12.2024 and the instant writ petition has been filed in the year 2026 without explaining the cause of delay, therefore, I
3 do not find any good ground to interfere with the order passed by the learned Claims Tribunal. Accordingly, this petition is dismissed. Sd/-
