And In the matter of : Samiran Mondal & Ors. ……Petitioners. Mr. Soumik Ganguli Ms. Priti Burman ……for the Petitioners. Mr. Anamitra Banerjee Mr. Utsav Dutta ….for the State. Learned advocate appearing for the petitioner submits petitioners and the family of the informant were involved in a scuffle. Pursuant to which injury was sustained by both the parties. State opposes the prayer and submits that four persons were injured. Kartik Bauri was severely injured. There were other injured persons. So far as petitioner no. 1 is concerned, his prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner no. 1, namely, Samiran Mondal be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Petitioner no. 1 will meet with the investigating officer within a period of 10 days and thereafter on all subsequent dates fixed by the investigating officer till the report in final form is submitted before the jurisdictional Court.
