CRL OP No. 16051 of 2026 __________ Page2 of 4 ORDER The petitioner as complainant filed a petition under Section 156(3) of Cr.P.C. in Crl.M.P.No.7965 of o2024 before the XVI Metropolitan Magistrate, George Town, Chennai. The Lower Court instead of forwarding the complaint, took the complaint on his own file and examined the petitioner as a witness on
25.07.2025. Thereafter the case was taken on file for offence under Sections 109, 465, 120-B, 468, 420 and 379 of I.P.C. 2.The contention of the petitioner is that there are two accused in this case, summons served to A1 and A2 evading summons. The trial Court is not taking effective steps to proceed with the trial and it is at the stage of summons. Hence, filed this petition. 3.It is seen that the petitioner had filed private complaint against the respondents 1 and 2. The second respondent/A2 in this case is none other than the Chief Manager of Canara Bank. The bank is still functioning in the said address. In view of the same, the trial Court is directed to ensure that the summons to the second respondent/A2 is served without any delay and after completion of service, proceed with the trial in this case and complete the trial within a period of nine months from the date of receipt of a copy of this order. This nine months period is only an outer limit. https://www.mhc.tn.gov.in/judis
