28.09.2026. Item No. 39. Court No. 758 ap W.P.A. 23700 of 2024 Sultana Bibi Mondal Versus The State of West Bengal & Ors. Mr. Arka Bhattacharya, Mr. Chandrachur Lahiri. …For the State. 1. None appears for the petitioner when the matter is taken up for hearing. 2. The instant writ petition was filed by the mother of a minor girl, who did not return home after 29th June, 2024. 3. Upon a missing complaint being lodged, Kalna Police Station Case No. 788 of 2024 dated 29.06.2024 under Sections 363/365 of the Indian Penal Code for investigation. The writ petition was filed, inter alia, seeking recovery of the missing child. 4. A report has been filed by the Criminal Investigation Department, West Bengal wherefrom it appears that after registration of the said case, the child was recovered on 31st January, 2025 after raid and rescue operation was conducted on Mogra Police Station area. On such raid being conducted, the victim girl was recovered from the possession of one, Sagar Bachhar. The recovered girl was produced before the CWC, Purba Bardhaman and was subsequently restored to her parents. Her statement under Section 164 of the Code of Criminal Procedure was also 2 recorded before a Judicial Magistrate. Separate case was registered for investigation against Sagar Bachhar which resulted in submission of a charge-sheet by Kalna Police Station Charge-sheet No. 257 of 2025 dated 28th March, 2025 under Sections 363/365/366/366A of the Indian Penal Code and Section 6 of POCSO Act. The said report of the CID, West Bengal dated 14th August, 2026 is taken on record. 5. It also appears from the said report that the petitioner has not been appearing for a considerable period of time. 6. Upon perusal of the prayer made in the writ petition, it is evident that the writ petition was filed, inter alia, seeking recovery of the minor child. It is quite understandable that the petitioner is no longer pursuing this writ petition as the minor girl has already been recovered and handed over to the parents. 7. In such view of the matter, W.P.A. 23700 of 2024 is disposed of with the above observations. 8. There will be no order as to costs. 9. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court. (Anuj Singh, J.)
