Respondents ASHOK SAHU Digitally signed by ASHOK SAHU Date: 2026.03.03 10:36:57 +0530 2 For Petitioners : Mr. Harsh Dave, Advocate For State-Respondents : Mr. Anmol Sharma, Panel Lawyer (Single Bench) Hon'ble Shri Justice Sanjay K. Agrawal Order on Board 02.03.2026 1. This writ petition is directed against the impugned order dated 15.10.2018, by which the petitioners’ application for grant of compassionate appointment has been rejected on the ground that other family members are already in the government service. 2. Mr. Harsh Dave, learned counsel appearing for the petitioners, would submit that respondent authorities were unjustified in rejecting the application of the petitioners by recording a finding which is perverse to the record, therefore, the impugned order deserves to be set aside. 3. Mr. Anmol Sharma, learned State counsel, would submit that the respondent authorities while rejecting the application of the petitioners have clearly recorded a finding that the deceased’s two brothers are already in the government service and husband of the petitioner No.1 is also in the government service, therefore, no compassionate appointment can be given in light of Column 2(1) of 3 the circular of the State Government dated 29.08.2016, which is in accordance with law. 4. I have heard learned counsel appearing for the parties and perused the documents meticulously. 5. In view of the circular of the State Government dated 29.08.2016, the petitioner No.1 is not entitled for compassionate appointment, as two brothers of the deceased and husband of the petitioner No.1 are already in the government job. As such, I do not find any merit in this petition and accordingly, the same deserves to be and hereby dismissed. Sd/- (Sanjay K. Agrawal) Ashok Judge
