1. This bail application has been filed by the accused-petitioner under Section 483 B.N.S.S. in connection with F.I.R. No.275/2025, registered at Police Station Khoh, District Deeg, for the offence(s) punishable under Section(s) 61(2)(a), 303(2), 308(2), 313, 317(2), 317(4), 317(5), 318(4), 319(2), 336(3), 338 & 340(2) B.N.S. and Section 66D of IT Act.
2.
Learned counsel for the petitioner submits that the accused- petitioner has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned counsel further submits that the petitioner has no criminal antecedent, he is in custody since 30.01.2026 and no recovery is required to be made from him. Learned counsel also contends that charge-sheet has been filed in the matter and trial will take considerably long time in its conclusion, so no fruitful purpose would be served by
[2026:RJ-JP:8830] (2 of 3) [CRLMB-3213/2026] keeping the petitioner in custody, therefore, the benefit of bail under Section 483 B.N.S.S. may be granted to petitioner.
3. Per contra, learned Public Prosecutor opposes the
submissions made by learned counsel for the petitioner hereinabove and submits that the offence against the petitioner involves serious cyber fraud activities. He further submits that one complaint has been registered against the petitioner on the National Cyber Crime Reporting Portal (NCRP).
4. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that charge-sheet has been filed in the matter and trial will take considerably long time in its conclusion, thus, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.
5. Therefore, the instant bail application is allowed and the accused-petitioner, namely Pradhum S/o Sh. Natholi, is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the Trial Court, with the following conditions:- (i) The accused-petitioner shall not tamper with evidence or influence the witness in any manner.
