The applicants have preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of anticipatory Bail, apprehending their arrest in connection with Crime No.09/2026 registered at Police Station – Mahila Thana, Raigarh District – Raigarh (C.G.) for the offence punishable under Sections 78(2), 126(2), 79, 75(3), 3(5) of BNS, 2023. Case of the prosecution, in brief, is that the prosecution story in brief is that the prosecutrix/ complainant lodged written report at Police Station, Mahila Thana, Raigarh, alleging therein that on 09.02.2026 at about 11.10 AM, she along with her sister were going to Raigarh by her Car for purchasing medicine, at that time near Chandmari Mahraj Kirana, while they giving biscuit to the dogs, at that time, 5 persons came in Car Grand Vitara bearing Registration No. CG-12-AW- 2410 and stopped near the car of complainant and giving flying kiss the complainant and insinuating obscene act and using obscene words towards the complainant, but the complainant avoided the same and going towards Raigarh. After sometime, the said persons stopped the car of complainant near Riyapara Triangle and again doing obscene act and one accused Pradeep Patel taken down his cloth and shown his private part to the complainant, due to which, the complainant & her sister returned to house without purchasing the medicine and informed the incident to her parents. On the basis of above report, the aforesaid alleged offences have been registered against the accused persons. 3.
Learned counsel appearing for the applicants submit that the applicants are innocent and have been falsely implicated in the present case. It has been contended that, insofar as the applicants are concerned, the primary allegations leveled against the co- accused, Pradeep Patel, merely pertain to their association with the main accused. Therefore, he prays for grant of anticipatory bail to the applicant. 3

On the other hand, learned counsel for the State opposes the bail application and submits that on the date of incident present applicants were with the main accused, Pradeep Patel and tried to moles the victim, who was along with her sister and both were gone to purchase the medicine by car, wherein main accused Pradeep Patel giving flying kiss to the victim and insinuating obscene act and using obscene words but the victim avoided the same and going towards Raigarh. After some time, they stopped the car of the victim near Riyapara Triangle and again doing obscene act and Pradeep Patel took down his cloth and showed his private part to the victim and her sister. He further submits that present applicants were also present in the car and laughing at the victims and making comments about them. Therefore, applicants are not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Upon consideration of the submissions made by learned counsel for the parties and on perusal of the case diary, this Court finds that the allegations against the applicants disclose active participation in the incident. The nature of the accusations, the manner in which the offence was allegedly committed, and the gravity of the offence, which is of serious nature i.e. molesting a girl, I am not inclined to grant anticipatory bail to the applicants. 7.
Accordingly, this first bail application of applicant No.1 –Rahul Gupta, applicant No.2 – Kamlesh Yadav, applicant No.3 – Sangam Tripathi involved in Crime No.09/2026 registered at
4 Police Station – Mahila Thana, Raigarh District – Raigarh (C.G.) for the offence punishable under Sections 78(2), 126(2), 79, 75(3), 3(5) of BNS, 2023, is rejected at this stage. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
