Criminal Miscellaneous Bail Application No. 4143/2026 Bablu S/o Shri Prem Singh, Aged About 45 Years, Resident Of Gavda Meena Police Station, Sadar Hindaun City, District Karauli (Raj.) (At Present In Sub Jail Hindaun City Karauli) ----Petitioner Versus State Of Rajasthan, Through Public Prosecutor ----Respondent For Petitioner(s) : Mr. Dinesh Yadav with Mr. Ankit Yadav For Respondent(s) : Mr. Vijay Singh Yadav, P.P. HON'BLE MR. JUSTICE RAVI CHIRANIA Order 18/03/2026 1. This misc. bail application has been filed by the petitioner Bablu S/o Shri Prem Singh, under Section 483 of B.N.S.S. challenging the order dated 06.03.2026 passed by the Additional District and Session Judge No.2, Hindaun City, District Karauli, whereby the bail application of the petitioner was dismissed as he breach the conditions of the previous bail order. On rejection of the bail by order dated 06.03.2026, the petitioner has preferred this bail application under Section 483 of B.N.S.S. 3. Learned counsel for the accused-petitioner submitted that the petitioner was regularly appearing before the learned Trial Court in the trial pending since 2016, however, could not appear before the learned Trial Court on 26.10.2023 and therefore, his bail bonds were forfeited and arrest warrants were issued. Learned counsel further submitted that the petitioner was arrested [2026:RJ-JP:11514] (2 of 3) [CRLMB-4143/2026] by the police and since then he is behind the bars. Learned counsel submitted that non appearance of the accused-petitioner was bona-fide and unintentional. Learned counsel also undertakes that the petitioner shall appear before the learned Trial Court on each and every date as fixed by the Court and the petitioner shall not make any attempt to jump the bail again, and therefore, in the interest of justice, the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor strongly opposed the bail application. 5. Taking into consideration the overall facts and circumstances of the case, as also the undertaking of the learned counsel made on behalf of the petitioner that he shall appear on each and every date as fixed by the learned Trial Court, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner Bablu S/o Shri Prem Singh on bail. 6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Bablu S/o Shri Prem Singh shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear [2026:RJ-JP:11514] (3 of 3) [CRLMB-4143/2026] that the observation as made by this Court in the bail application will not affect the trial of the case. (RAVI CHIRANIA),J Monika/77
