WPA 14675 of 2025 (Kritisubhra Das & Ors. vs. State of West Bengal & Ors.)
Mr. Aditya Mondal Mr. Tamoghna Pramanick Mr. Chiranjit Pal …. For the Petitioners Mr. Anish Kr. Mukherjee Ms. Megha Datta …. For the State Mr. Gourav Das Mrs. Kamal Mishra …. For the Private Respondents
Affidavit of service and supplementary affidavit filed by the petitioners are taken on record.
Learned counsel for the petitioners submits that the private respondents are raising unauthorised construction on the plot of land classified as ‘Jal’ in the L.R. Record of Rights without conversion of the same and without obtaining sanction from the concerned authority. The petitioners submitted a representation in this regard before the concerned authority on 7th June, 2025 which is yet to be considered. The petitioners seek
consideration of the same.
Learned counsel submits that pursuant to the representation submitted by the petitioners, a stop work notice was issued by the Pradhan, Janka Gram Panchayat on 12th June, 2025 despite which the construction is going on.
2 Denying such allegation, learned counsel for the private respondents submits that no further construction has been made after service of the stop work notice. The private respondents are raising construction after conversion of the plot in question and obtaining sanctioned building plan from the concerned Panchayat. The contention of the parties need to be verified by the appropriate authority. Since the representation submitted by the petitioners in this regard is pending, the Pradhan, Janka Gram Panchayat being the 3rd respondent herein, is directed to consider and dispose of the same within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioners and the private respondents in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law. The stop work notice shall remain effective till the disposal of the representation. The writ petition is disposed of. There shall be no order as to costs.
3 Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
