Court No. 758 29.9.2026
(Item No. 10)
(AB)
W.P.A. 16548 of 2024
Piyush Shaw VS The State of West Bengal & Ors. Mr. Guddu Singh
…. For the petitioner
Ms. Suchitra Sinha Chatterjee
Mr. Mainak Chandra
…. For the State
The grievance of the petitioner is that on 11th September, 2023 an altercation between the petitioner and three others along with the police personnel happened during NAKA checking duty on Purulia-Barakar Pitch Road (SH-5) near Maa Mansa Petrol Pump. The altercation led to registration of a case against the petitioner and three others, being Neturia Police Station case No. 78 of 2023 dated 11th September, 2023 under Sections 341/186/353/332/333/337/338/34 of the Indian Penal Code. It is the contention of the petitioner that the aforesaid case filed against the petitioner and three others is false and fabricated. According to petitioner, the Police had assaulted the petitioner and then proceeded to falsely implicate him in a criminal case, which has now culminated into a charge sheet. According to petitioner, the Police has misused its power and authority by assaulting the petitioner and
2 upon protest being made, false criminal case has been filed against the petitioner. In the aforesaid factual matrix, the petitioner has lodged a complaint dated 3rd October, 2023 before the Chairman of the National Human Rights Commission bringing on record the entire sequence of events and requesting the authority to look into the matter. The petitioner also relies upon a status report from the website of the National Human Rights Commission to submit that upon such complaint being lodged the Commission had transmitted the complaint of the petitioner to the concerned authority for appropriate action. The Commission had further directed that appropriate action be taken within eight weeks associating the complainant/victim and to inform him of the action taken in the matter. The grievance of the petitioner is that the complaint dated 3rd October, 2023 has not been looked into or acted upon. The petitioner has not been called upon or involved in any purported enquiry into the said complaint. A report was called from the State. The State has submitted the report dated 24th August, 2025. The learned advocate representing the State has submitted that the petitioner along with three others are notorious.
They have not only been involved in present altercation with Police, there are two other cases being Neturia Police Station Case No.
3 133 of 2022 dated 20th December, 2022 under Sections 448/232/307/506/34 of the IPC and Neturia Police Station case no. 72 of 2023 dated 4th September, 2023 under Section 3(1)(X) of SC & ST (Prevention of Atrocities) Act, 1989 where charge sheets has been submitted against the petitioner. According to the State, the complaint dated 3rd October, 2023 has also been looked into and enquiry report dated 5th November, 2023 has been placed before this Court. Having considered the submissions of the parties it appears that, the report dated 5th November, 2023 submitted by the State has no reference to the complaint dated 3rd October, 2023. It also does not appear that the petitioners were in any way called upon or made to participate in the purported enquiry that has been conducted. Since the grievance of the petitioner is that the petitioner’s right has been violated, it is necessary that the petitioner be involved any such investigation that has happened. It does not appear that the petitioner was even informed of the outcome of the said enquiry. In such view of the matter and without going into the matter the allegation made by the petitioner, the respondent no. 3 is directed to look into the allegations contained in the letter dated 3rd October, 2023 and check its veracity. The petitioner along with three others may also be permitted to participate
4 in the enquiry. Upon such enquiry being conducted the petitioner be informed of the outcome of such investigation and taken to its logical conclusion. With the above observations and directions this Writ Petition being W.P.A. 16548 of 2024 is disposed of. It is needless to mention that, this Court has not commented on the veracity or the authenticity of the allegations made by the petitioner in the said complaint on 3rd October, 2023.
This order is passed only for the purpose of transparency and accountability. Accordingly the writ petition being W.P.A. 16548 of 2024 stands disposed of, without any order as to costs. Photostat certified copy of this order, if applied for, be furnished expeditiously. (Anuj Singh, J.)
