This misc. bail application has been filed by the petitioner Sakir S/o Amin, who was arrested by the police in connection with the FIR bearing No.121/2018 dated 25.04.2018 registered at Police Station Nagar, District Bharatpur for the offences punishable under Sections 420 and 382 IPC. 2. Learned counsel for the petitioner submits that the bail application filed by the petitioner was rejected by the Additional District and Sessions Judge, Deeg vide order dated 24.02.2026, thereafter, the petitioner has preferred this bail application under Section 483 of B.N.S.S. 3. Learned counsel for the petitioner submits that the petitioner has no information about the said FIR as he was not called by the police for the investigation. Now, after more than eight years, he has been arrested by the police and is behind the bars since [2026:RJ-JP:11034] (2 of 2) [CRLMB-3495/2026] 20.02.2026. He further submits that no further recovery is required to be made from him and the co-accused Sapat has already been enlarged on bail by the Co-ordinate Bench of this Court in S.B. Criminal Miscellaneous Bail Application No. 12182/2019 dated 26.09.2019. In view thereof, the petitioner may be enlarged on bail by this Court. 4. Learned Public Prosecutor strongly opposed the bail application. 5. This Court considered the nature of the allegations, as the allegations are all triable by Magistrate, without commenting on the merits of the case, This Court is inclined to enlarge the present petitioner on bail by allowing the present bail application. 6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Sakir S/o Amin shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case. (RAVI CHIRANIA),J Dushyant/81
