GP FOR FINANCE PLANNING The Court made the following: SRK, J W.P.No.13984 of 2026 3 O R D E R This Writ Petition is filed seeking the following relief: “….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of respondents in not releasing bill amount of Rs.3,09,415.54 paise and Rs.3,31,416.78 paise and interest thereupon, due to the petitioner for the work executed in pursuance of Two Agreements dated 14.09.2023, entered with 5th respondent, as arbitrary, illegal, discriminatory, unjust enrichment, violative of the Fundamental Rights guaranteed under Articles 14, 19 and 21 of the Constitution of India, apart from being contrary to the orders of this Court issued from time to time and consequently, direct the respondents to release the bill amounts payable to the petitioner for the works executed by him under the aforesaid agreements, along with interest and pass such other order …” 2. Heard learned counsel for the Writ Petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development representing respondent Nos.1, 4 and 5, learned Assistant Government Pleader for Finance, representing respondent No.2, and learned Assistant Government Pleader for Revenue, representing respondent No.3. 3. The Writ Petitioner claims to be a Civil Contractor, used to execute all civil works as per the guidelines of the Government issued from time to time. The Writ Petitioner entered into Agreement vide Agreement No.Nil/2023-24, dated 14.09.2023 to execute the work of augmentation of PWS Scheme near Vanka at Aldapalli village, SRK, J W.P.No.13984 of 2026 4 H/o.Aldapalli G.P. of Amarapuram (M) and Agreement No.Nil/2023-24, dated 14.09.2023 to provide New Pipeline at Aladapalli, H/o.Aldapalli G.P. of Amarapuram Mandal. The Writ Petitioner completed the entire work and submitted M-Book, and the same was certified by the respondent Nos.5 and 6. The respondent authorities are due to release an amount of Rs.3,09,415.54 paise and Rs.3,31,416.78 paise to the Writ Petitioner in respect of the above Two Agreements. Though repeated requests have been made by the Writ Petitioner, the respondents are not paying the pending bills to the Writ Petitioner. According to Writ Petitioner, having executed the work satisfactorily, within the prescribed time, non-payment of the bill amount was arbitrary and unjustified. It was further contended that the delay in payment is causing severe financial hardship, necessitating the filing of the present Writ Petition seeking appropriate directions for release of the outstanding amount. 4. Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions received from the Executive Engineer, RWS & S Division, Penukonda-5th rsepondent, submits that the Writ Petitioner is entitled to a net amount of Rs.6,40,831/-. Learned Assistant Government Pleader further submits that the bill was submitted for CPO Office, Puttaparthi Sri Sathya Sai SRK, J W.P.No.13984 of 2026 5 District, but, the payment got cancelled due to non-availability of funds. The written instructions are placed on record. 5. Having regard to the fact that, there is no dispute with regard to the works executed by the Writ Petitioner and the amount payable to him, and in view of the submissions of the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay a sum of Rs.6,40,831/- (Rupees Six Lakhs Forty Thousand Eight Hundred and Thirty One only) to the Writ Petitioner within a period of Eight (8) weeks from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs of the Writ Petition.
