2. This is an application under Section 483 of BNSS, 2023 praying for grant of bail to the accused petitioner, namely, Ashadul Mandal, who has been arrested on 03.01.2026,
3. The petitioner herein, Ashadul Mandal, is hereby seeking regular bail in connection with Bongaigaon P.S. Case No. 01/2026 arising out of 68/2026 under Sections 178/180/3(5) of the BNS Act, 2023, which after completion of investigation has been registered into Sessions Case No. 20 of 2026 and poised for prosecution evidence with next date fixed on 20.04.2026.. 4. The scanned record has been received. 5. The present petitioner was arrested on 03.01.2026. The allegations were about dealing with fake Indian currency rupees (FICR). The copy of the charge- sheet has been annexed with the petition. 6. Ms. L. Banik, learned counsel for the petitioner submits that co-accused Jakariya Mandal, from whom also the contraband in the nature of fake currency was seized was granted bail by the learned Court below. 7. I have perused the said order available in the TCR. 8. Prosecution opposing the bail at this stage submits that there was recovery of fake Indian currency rupees (FICR) from this petitioner as well and that the aspect of parity would not come automatically. 9. I have perused the materials and considered the submissions. 10. Considering the length of detention, the fact that the case is poised for commencement of trial and the fact that co-accused from whom also there is recovery has been granted bail – I am of the considered view that this petitioner can also be granted bail subject to suitable conditions. 11. Accordingly, the petitioner, named above, is hereby allowed to go on bail of Rs.
50,000/- with one surety of the like amount to the satisfaction of the concerned learned Court and subject to the following conditions:- (i) The accused/petitioner shall not abscond. (ii) He shall be available for the trial, if one commences. (ii) He shall not hamper or tamper with evidence. (iii) He shall not commit any illegal activities or offences. 12. In case of violation of bail conditions, the bail would be liable to be cancelled. 13. Accordingly, this bail application stands allowed and disposed of. 14. Send back the case diary.
