This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 77/2025 registered at Police Station Samripath, District Balrampur-Ramanujganj (CG) for the offences under Section 103(1) of BNS. 2. As per the prosecution case, complainant Somari Bai lodged a report alleging that on 03.10.2025, accused-applicant came to home ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2026.04.07 10:05:59 +0530 2 after consuming alcohol and picked a quarrel with his father and threw him and assaulted with his hands, fists and feet on his chest and neck, due to which, complainant’s husband died. 3. Learned counsel for the applicant submits that the complainant being step mother has lodged a false report against the appellant with an intent to grab the entire land of deceased. He submits that the applicant is in jail since 05.10.2025; there are total 11 prosecution witnesses and there is no immediate possibility of disposal of case, therefore, he may be enlarged on bail. 4. Per contra, learned State Counsel opposes the bail application and submits that there are eye-witnesses to the incident namely Somari Bai (second wife of deceased) and son Sukhdev and as per the medical report, the death was homicidal in nature. 5. Having considered the submissions made by learned counsel for the parties and the over-all facts and circumstances of the case, I am not inclined to release the applicant on regular bail. Accordingly, this bail application is rejected. 6. However, looking to the custody period of the applicant the trial Court is directed to conclude the trial as early as possible. 7.
