Learned advocate for the petitioner submits that 17 witnesses have been examined out of the 26 witnesses and none of the witnesses have implicated the present petitioner which would inspire confidence to arrive at a finding of guilt. Additionally, it has been submitted that the petitioner no.1 is in custody for two years and the petitioner no.2 is in custody for one year nine months. Learned advocate for the State opposes the prayer for bail. Having considered the stage of the case where 17 witnesses have been examined and the prosecution intends to examine nine more witnesses and, the next date is fixed
2 on 07.04.2026, I direct the learned trial court that the if the evidence which has already been surfaced tilt in favour of the petitioner, the learned trial court would complete rest of the nine witnesses by 15th July, 2026. To that effect, the learned trial court would fix a regular schedule of the other witnesses to be examined. No unnecessary adjournment be granted to either of the parties. In case, any witness is absent, the learned trial court would proceed for evidence of the next witnesses without further delaying the trial. Having considered the stage of the case, I am not inclined to enlarge the petitioners on bail at this stage. Hence, the prayer for bail of the petitioners is Rejected. Accordingly, CRM(M) 583 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
