(Oral) By means of present writ petition, petitioner has sought the following reliefs:- “1. Issue a writ, order or direction commanding respondent (DLDA, Nainital) to formally consider, decide and finally dispose of the petitioner’s compounding application MAP/NDA/CC/0005/26-27, annexure no.3 page 24 filed in Case No.UCMS/NDA/C/0119/2023 within a strict, court-monitored timeframe of four weeks or at an earlier date in accordance with the law. 2. Issue a writ, order or direction to Respondent nos.1 & 2 to not to take any coercive measures including sealing or demolition until the said Compounding Application is fully and finally adjudicated. 3. Award exemplary costs against the private Respondents for harassment, and against the State for legal expenses.” 2. It is the submission of learned counsel for the petitioner that although some construction was made by him over the property in-question, for which a notice was issued to him under the provisions of the Uttarakhand Urban Planning and Development Act, 1973, the 2026:UHC:3245 2 petitioner deposited a fee of Rs.3,015/- with the District Level Development Authority and accordingly moved an application for compounding dated 17.04.2026 before the District Level Development Authority, Nainital, which is pending consideration. 3. Learned counsel for the petitioner in view of such submissions, confined his prayer to the extent that the compounding application moved by him before the Competent Authority may be directed to be decided at an early date. 4. The prayer is quite innocuous which deserves acceptance. 5. The writ petition is disposed of at the admission stage itself. The Competent Authority i.e. DLDA, Nainital is directed to decide the Compounding application dated 17.04.2026 moved by the petitioner as early as possible, preferably within three months from the date of production of a certified copy of this order. 6.
