Order 16/04/2026 The instant writ petition has been filed by the petitioner challenging the impugned order dated 07.04.2026, whereby, the respondents have transferred the petitioner from Gram Panchayat Bheempur, Panchayat Samiti Todabhim to Gram Panchayat Narolidang, Panchayat Samiti Sapotra.
Learned counsel for the petitioner submits that the petitioner is going to superannuate on 30.06.2026. In view thereof, learned counsel submits that the transfer order of the petitioner is highly

Learned counsel, Mr. Dheeraj Tripathi, appearing on behalf of the respondents strongly opposed the submissions raised by
learned counsel for the petitioner. Heard learned counsel for the parties. This Court, noted the fact that the petitioner is going to superannuate on 30.06.2026 and considering the fact that the respondent-Department will have to undertake necessary formalities and preparations in relation to pension and other retiral benefits. In view thereof, it would not be justified to effect the transfer of the person who is on the verge of superannuation in less than three months. In view of the above discussion, the writ petition is allowed and the transfer order dated 17.03.2026 is declared as illegal and bad in law and the same is quashed and set aside. There shall be no order as to costs.
