1. The instant appeal has been filed under Section 14A(2) SC/ST (Prevention Of Atrocities) Act on behalf of the appellant, who is in custody in connection with FIR No. 23/2026 registered at Police Station Shivaji Park District Alwar for the offence(s) under Sections 318(4), 316(2), 351(2), 352 of BNS and Section 3(1)(r), 3(1)(s), 3(2)(va) of SC/ST Act and as per charge-sheet under Section 317(2), 318(4), 316(2), 351(2), 352 of BNS and Section 3(1)(r), 3(1)(s), 3(2)(va) of SC/ST Act.
2. It is stated that service has been carried out upon the complainant/victim. Despite service, no one has appeared on behalf of the complainant/victim.

Learned counsel for the accused-appellant submits that the appellant is a young man aged 24 years. It is submitted that the matter is triable by Sessions Court as matter pertains to
[2026:RJ-JP:11662] (2 of 2) [CRLAS-358/2026] SC/ST Act. It is further submitted that present matter pertains to money dispute of Rs. 50,000/-. It is also submitted that marriage of the appellant's sister is scheduled in the next week.
3. Per contra, learned Public Prosecutor has opposed the appeal.

Having heard the arguments advanced by the learned counsel for the parties and considering the fact that accused- applicant is a young man of 22 years; that the matter is triable my Sessions Court; that it was an inter se dispute between the parties regarding some petty in nature; that marriage of the applicant’s sister is scheduled in the next week and looking to the overall
facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-appellant and enlarge him on bail.
5. Consequently, the instant appeal is allowed. The impugned order dated 05.02.2026 passed by the Special Judge, SC/ST (Prevention Of Atrocities) Cases, Alwar is set aside. It is ordered that the accused-appellant Aazad @ Sahil Khan Son Of Rujdar Khan arrested in connection with aforesaid FIR, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
