1. Heard Ms. R. D. Mozumdar, the learned counsel for the applicant. Also heard Mr. F. A. Hasan, the learned counsel for the opposite party No.1.
2. This Interlocutor Application has been filed by the applicant/Insurance Company in connection with MFA Case No. 16/2025, praying for staying the execution of the impugned judgment and award dated 19.08.2025 passed by the Commissioner Employee’s Compensation, Nagaon in NEC Case No. 17/2022, whereby the applicant was directed to pay a sum of Rs. 16,75,385/- to the claimant/opposite party.
3. Since, the learned counsel for the claimant/opposite party No.1 has not opposed to the prayer on the ground that 50% of the awarded amount may be directed to deposit by the applicant and since, he submits that the claimant would be filing separate application for allowing the applicant to withdraw the same, the notice to the respondent No.2 is waived and this Interlocutory Application is allowed.
4. The execution of the impugned judgment dated 19.08.2023 passed by the Commissioner Employee’s Compensation, Nagaon in NEC Case No. 17/2022 shall remain stayed during the pendency of the connected MFA Case No. 16/2025 subject to deposit of 50% of the awarded amount by the applicant before the Registry of this Court within

5. The claimant may file a separate Interlocutory Application for withdrawal of the same, as desired by the learned counsel for the claimant.
6. This Interlocutory Application is accordingly, disposed of.
